got off the ground. and a good morning to you. happy independence day. i'm josh elliott here today with elizabeth vargas as robin and george are enjoying the holiday with their families. let's face it perhaps a measure of slslp. >> let's hope so. we all celebrate our nation's birthday. lots of news. we begin with that breaking news off the coast of baja, california. a tourist boat has capsized. dozen of people have been thrown into the water. bianna is here with the latest. >> reporter: 44 tourists were onboard. most of them americans. the boat was operated by baja

fishing. the boat was found 87 miles south of san felipe. we're told that all americans were accounted for. at least 27 americans have survived. we're still working to confirm that all americans are okay. six other people are currently missing. one person we know has died. the u.s. coast guard is laun launching a helicopter from san diego to help search for those still missing. it capsized in the heavy seas. >> it sank closer to shore. some were rescued by the mexican navy. >> again, 44 tourists were onboard. most of them americans. indications that all of them are accounted for right now. we're still working to confirm that. elizabeth, you have been there.

a big tourist destination. >> the water there is very deep and attracts a lot of deep-sea fishing. elizabeth, now, to the latest on the explosive closing arguments in the casey anthony trial. a trial that has transfixed with some bizarre turns. judge belvin perry took the step of halting proceedings as the opposing attorneys lost their collective cool. >> reporter: good morning, josh. those closing arguments were rieflting. full of twists and turns. at one point the judge threatened to throw boft attorneys off the case and there's more to come this morning. >> there wasn't piece of duct tape over caylee's face. there were three. overlapping at angles. >> reporter: if you believe the

prosecution, casey anthony was a party girl who wanted freedom at any cost. >> and she died because her mother decided that the life that she wanted was more important. >> reporter: if you believe the defense, she was a victim. >> casey reacts the way she does and lies because of the environment that she was brought up in. >> reporter: with bad judge as her only crime. >> this was an accident that snowballed out of control. >> reporter: an emotional back and forth for casey anthony in tears one moment, and showing stone-faced defiance the next, as jeff ashton talked about little caylee's death. >> we can only hope that the chloroform was used before the tape was applied. so that caylee went peacefully. >> hope? you're not supposed to hope. you're supposed to prove cases beyond the reasonable doubt.

>> reporter: the judge ruled they failed to prove allegations of sexual abuse. >> there is no evidence that the defendant was sexually molested. >> reporter: despite the setback jose baez went on the attack for three hours. >> the situations like fantasy searches, fantasy forensics. phantom stickers. phantom stains. >> the people from the fbi who inspected the shovel, there's no evidence, no dna, they went crazy trying to find more hairs, so they could say, this came from a dead body. the test for chloroform, negative. all of these other drugs, negative, negative. >> reporter: even theersed flared. at one point, jose baez called out prosecutor ashton for laughing at him. >> objection. >> reporter: the judge immediately stopped proceedings. threatening to throw both of

them off the case. >> i have constantly told both sides, i personally gave each one of you the ninth jurisdiction courtroom policy. >> reporter: the prosecution will have the final word today. they'll present their rebuttal shortly. after six long weeks this case will finally go to the jury. we'll be taking a closer look at the successes and failures at both sides and our legal team, dan abrams and nancy grace standing by to join us live. new twists in another case that's been making a lot of headlines. the case of the new york hotel maid accusing the former international monetary fund chief dominique strauss-kahn of sexual assault. there are new questions now about the accuser's life and this may have derailed the case. abc's linsey davis is here with the very latest. denying this morning that the case is dead. >> reporter: it's her

credibility that's being called into question. dominique strauss-kahn has claimed all along that he's innocent. now the case hasurned dramatically in his favor. so drastic, we could see a possible dismissal sooner than the next court date. more startling accusations about dominique strauss-kahn's accuser. according to the new york post, she routinely traded sex for money. but sources close to the defendant denied that to abc news. calling it a complete fabrication. however, the d.a.'s case has been crippled. a three-page letter outlined her lies and inconsistencies about the case. >> i think you can understand why we believe from the beginning that this case was not what it appeared to be. >> reporter: just days after strauss-kahn's arrest the hotel maid reportedly called her boyfriend in immigration jail in arizona and told him don't worry, this guy has a lot of money, i know what i'm doing.

in addition to cheating on her taxing also reports of several bank accounts in her name with large sum of money. >> she lead about the current offense and certain things surround it. that makes all of the lies in her past relevant. >> reporter: one part of her story has not changed. she maintains that she was sexually assaulted. >> you cannot become blind to the physical kor baiting evidence. >> reporter: with the d.a.'s case weakened, he's been released from house arrest and is free to travel within the u.s. within a matter of weeks, he could walk as afree man and return to france. >> the next court date is set for july 18th. now even if the d.a. decides to drop all of the charges, the

victim could still sue him for monetary damages in civil cute. a chance that the victim could charge with if some of the more extreme charges prove true. let's check back in with bianna golodryga. >> latest developments coming in the exxon mobil oil spill. this morning, montana's governor said that they're just guessing at the amount of damage from this spill. down playing the environmental effect. here's abc's neal karlinsky. >> reporter: pell cans swimming in oily water. this is the yellowstone river in montana, a normally pristine slice of nature now marked by an oil spill that couldn't have come at a worst time. the river has been surging for months. now, it's mixed with oil, too.

>> at this time, we don't know the root cause. this is a very unusual event. obviously, we have a large amount of oil entering the water very quickly. >> reporter: exxon shut down the same line in may over concerns rising flood waters. the spill started when a 12-inch pipeline began leaking underneath the yellowsto river. exxon mobil officials say a pressure change was detected and the line was shut off within six minutes. but the damage was already done. spilling some 42 gallons o o oi and leaving sheens in the water reportedly seen up to 100 miles from the leak. the yellowstone is a tributary to the missouri river, so the concern now is to stop the oil before it flows further. for "good morning america," neal karlinsky, abc news, seatttt.

meanwhile the royal couple is getting a reception worthy of rock stars. the sun says that kate talked about wanting children. that's big news. and bob woodruff has the latest. >> reporter: good morning. very interesting news day today. fantastic morning here. you know that prince william is actually military helicopter pilot, he's going to flying himself over the water here in what's called a emergency landing procedure. he's going to land it to prevent it from flipping over later on, a competition between him and his wife, kate n a dragon boat race. under the hong kong tradition. we'll find out soon who's going to win that thing later today. this has been a very, very successful time.

crucial ruling that the defense couldn't mention their theory that casey's father sexually abused her and that's what led to casey's inappropriate behavior. >> i think it was the correct ruling. if you can't present evidence you can't bring it. i think it may helped the defense. the fact that weren't able to go off on what i view a tangent actually may have helped the defense's case. >> nancy, i was struck listening to jose baez's harsh language in his closing yesterday. he repeatedly called casey a liar, how do you think it went over on the jury? >> i don't think it went over very well at all. being a liar and slut is pretty much legal in every jurisdiction

in this country. it's not good to put out your client's bad points. the defense had casey anthony barricaded by from the jury by visual aids. that was intentional. it's founded in the law. you can't argue some zanny theory to the jury. dan's spin to put a good face on it for the defense it's good for them that a major prong of their case was ruled out in closing statements is crazy. they were relying on that. her alleged sexualization by father and brother which is improbable. >> nancy, wait -- >> to explain her behavior for 31 days. >> but if you think it's improbable -- nancy, hang on one

they're going to get snookered by the prosecution. it didn't show any level of respect for the jury. >> he repeatedly said that the prosecution hasn't given any evidence of where caylee died or when caylee died. >> i think that in instead of focusing on as many answers they posed more questions. meaning that recognize now that the best argument they have reasonable doubt as to the cause of death. instead of saying, we know exactly how she died -- hang on one second, nancy. instead of focusing on this sort of -- you know, those long-shot-type arguments and definitive answers as to exactly how she died in the pool, they're sailing, we don't know how caylee died. >> nancy?
